With the Supreme Court’s recent decision in Amgen Inc. v. Sanofi, 598 U.S. 594 (2023), re-directing the legal analysis for Enablement, as well as creating considerations for Written Description, Applicants and Patentees need to re-craft IP strategies for capturing early-stage technologies that functionally claim their invention. Drs. Julie Meigs (Womble Bond Dickinson) and Bernard Brown, II (Michael Best) will offer guidance in the post Amgen v. Sanofi era.
